General

By accessing and using HeyGen's AI video generator application programming interfaces, software, tools, data, documentation, or website (collectively, “Services”), you expressly agree that you have read and agree to be bound by the following terms and conditions (the “Terms”) as well as all applicable laws and regulations, including those related to the AI video maker. If you are ready to create, you can start a free membership with HeyGen.

These Terms, and any policies incorporated into these Terms, contain the entire agreement between you and HeyGen regarding access to or use of the AI video generator Services. Other than any service-specific terms of use or any applicable Enterprise agreements, these Terms supersede any prior agreements or understandings.

No agency, partnership, joint venture, or other relationship is intended or created by your access to or use of the Services.

You may not assign or delegate any rights or obligations under these Terms. Any purported assignment or delegation by you shall be null and void. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, or to any affiliate as part of a corporate reorganization.

License to Use the Services

We grant you a non-exclusive right to access and use the Services in accordance with these Terms. HeyGen retains all rights to the AI video generator Services. License to Your Content

Term and Termination

These Terms become effective when you first access the AI video generator Services and remain in effect until terminated. You may terminate these Terms anytime by discontinuing use of the Services and deleting your account. Upon termination, we may delete any of your Content.

Confidentiality

You may access Confidential Information of HeyGen through your use of the Services, and you will use it only as needed to access the Services. Information should be treated as “Confidential Information” if it is marked as such or should reasonably be considered confidential.

Subscription Services; Payment

Subscriptions

Accessing certain Services may require subscription payments, and by using those Services, you agree to pay the recurring charges. Your Recurring Subscription will automatically renew until canceled. You authorize HeyGen to store your payment information for these charges.

Other Usage Charges

If your usage of the Services exceeds the provided limits, you will be charged overage fees at current rates available.

Payment

You represent that you have the right to use any payment method you provide.

Refunds and Exchanges

Payments are non-refundable, except where required by law.

Reservation of Rights

HeyGen reserves the right to impose conditions on any promotional offers.

Exclusions and Limitations

THE SERVICES ARE PROVIDED "AS IS." WE MAKE NO WARRANTIES ABOUT THE SERVICES.

Revisions and Errors

The Services may include errors. HeyGen does not warrant that the Services are accurate or current.

Redistribution or Republication

Redistribution or republication of any part of the Services is prohibited without consent.

Third-Party Material in the Services

We do not monitor third-party content linked to or accessible from the Services.

Our Intellectual Property

The Services contain intellectual property owned by HeyGen. You are prohibited from modifying or distributing any portion of the Services without consent.

Indemnification

You agree to indemnify and hold us harmless from any losses or damages arising from your breach of these Terms.

Notification of Changes

We may modify these Terms from time to time. Continued access or use of the Services after changes indicates acceptance of the modified Terms.

Mobile Terms

If you download our mobile application, you acknowledge that HeyGen is solely responsible for the Services.
